Article 1

The National Taiwan University (NTU or “the University”) Library (“the Library”) formulates the NTU Library Directives for Resource        Reproduction and Usage Fees for Library Special Collections (“the Directives”) to offer appropriate reproduction and usage services for its special collections resources.

Article 2

“Special collections resources” shall refer to the special resources held by the Library’s Special Collections Division and pay-per-use resources that have been digitized by the Library.

“Reproduction” shall include the copying, printing, video recording, photographing, or electronic duplication of a resource, or other similar means of reproduction.

“Use” and “usage” shall refer to the reproduction, distribution, editing, publication, public display, public screening, public broadcast, public transmission, or other means of utilization of a work whether in analog or digital form.

Article 3

The Library shall determine the appropriate reproduction method(s) for each resource based on its state of preservation, and copies of a resource shall be made from a prior reproduction where available. Resources published in or before 1850 are not available for photocopying.

Article 4

The following resources are not available for reproduction:

  1. Those in poor condition and in need of repair or remounting, resources printed on fragile paper, resources with severe insect damage, resources with hardened or stuck pages, and resources with easily damaged bindings
  2. NTU yearbooks
  3. University historical data containing private or personal information
  4. Resources of which a reprint, photocopy, or microform/digital copy is already available.
  5. Rare-edition copies or the only copy extant of a work in Taiwan of ancient thread-bound Chinese or Japanese volumes as well as the microform, digital, and hardcopy reproductions of these resources
  6. Resources that the copyright holders prohibit from being made public
  7. Other resources which are deemed by the Library to be inappropriate for reproduction or which are restricted by an applicable contract

Article 5

Organizations and units (“applicants”) that wish to reproduce the entirety of a special collections resource shall apply via an official document. Any reproduction of special collections resources that are rare-edition copies or the only extant copy of a work in Taiwan shall be based on the principle of equality and reciprocity. Any reproduction of such resources may only be used for the purpose(s) stated on the official document and may not be reproduced for distribution, publication, or other commercial use without authorization. The Library may require the applicant to sign a contract to such effect.

Article 6

Unless otherwise stipulated in writing, applicants’ use of reproduced image, audio, and video files of a requested special collections resource is limited to one time only. Such files may not be transferred to any third parties. Applicants shall also comply with the provisions stipulated herein and other restrictions on reproduction or use imposed by the Library. Applicants who wish to use such reproductions for a second time or for other purposes shall submit a new request.

Article 7

The Library’s special collections resources may be subject to copyright or other rights held by a third party, and usage granted by the Library in accordance with the Directives is limited to the scope of the intellectual property rights or legal licensing/authorization rights held by the Library. Applicants shall verify the attribution of rights and comply with the Copyright Act and other applicable laws. If a license/authorization is required, it must be obtained from the relevant rights-holders. Applicants shall be held solely accountable for any legal liability arising from violations of the Copyright Act or other applicable laws.

Article 8

When using reproduced images or videos from a special collections resource, applicants shall indicate “National Taiwan University Library Collection” or “Provided by National Taiwan University Library” on the relevant publication and supply two copies of the publication to the Library.

Article 9

Special collections resource reproduction and usage fees are shown in the Appendix. Applicants shall pay the necessary fee by the applicable deadline, after which the Library will begin processing the request. Cases not stipulated in the Appendix shall be handled separately.

Article 10

The Directives shall be passed by the Administrative Meeting and then implemented on the date of promulgation.

  • Full copies shall be made in a format approved by the Special Collections Division, and fees shall be charged per number of “pages” printed (and not “sheets” in the case of duplex printing).

3. Notes

  1. Only one edition of the audio and video files listed in Table 2 may be published (no additional charge for reprints of the same edition). Exhibitions of such files shall be limited to the same exhibition series and within the same year only. In principle, such files may only be used for one year on a webpage, and usage shall be consistent with that stated on the application document; additional charges will be levied if a file is used for more than one year, as indicated in Table 2. Such files may only be broadcast on a single program. The fees or royalties assessed by the Library for other commercial uses shall be negotiated separately.
  2. If a mailing service is required by the applicant, a processing fee of NT$50 per parcel will be charged in addition to the actual postage required. For digital files to be stored on more than one storage medium, a processing fee of NT$50 per additional storage medium will be charged.
  3. In the event of special considerations or a need for professional processing by a third-party service provider, the fee shall include the service charge and processing fee. The service charge shall be indicated on the invoice provided by the service provider, and the processing fee shall be NT$200 per item or book.
  4. For large-quantity applications, the processing time may be extended as necessary.
